Meta is gearing up for a pivotal trial starting this week, following two previous legal setbacks on child safety issues. The trial, held in Oakland, California, involves a federal case overseen by U.S. District Judge Yvonne Gonzales Rogers. Despite an eight-person jury being part of the process, their role is advisory, with the final decision resting with Judge Rogers.

Anticipated to span six weeks, the trial may see Meta’s CEO Mark Zuckerberg and Instagram head Adam Mosseri called to give testimony. The lawsuit traces back to nearly three years ago when multiple states jointly filed a complaint alleging that Meta, the parent company of Facebook and Instagram, violated laws by collecting data from users under 13 without parental consent.

Accusations in the 233-page complaint claim that Meta deliberately obscured the negative effects and addictive nature of its platforms on young users while profiting from data exploitation and targeted advertising. The trial’s first phase involves four states, with potential follow-up trials by 25 other states pending the outcome. Legal experts believe a significant ruling against Meta could lead to the company seeking to evade further litigation.

Meta’s defense refutes the claims, asserting its commitment to youth protection through various safety measures implemented since the lawsuit began. The company faces substantial financial risks, with a potential penalty reportedly reaching up to $1.4 trillion, a sum contested by legal experts as unrealistic and potentially crippling for Meta. In addition to financial penalties, the plaintiffs seek court orders mandating alterations to Meta’s platforms, such as age restrictions and eliminating certain features like infinite scroll.

The ongoing legal battles are part of a broader landscape where Meta confronts multiple lawsuits in various jurisdictions, including claims from school districts and individuals in the U.S. and Canada. Despite Meta’s efforts to enhance safety features and deny culpability, the outcome of the trial could have far-reaching implications for the tech giant’s future operations and legal standing.
