Dorothy Cook, a dedicated caregiver, took care of her husband Melvin for 49 years after he was diagnosed with a rare brain condition. However, her ability to make decisions for him was challenged when a doctor refused to discharge him from the hospital due to the absence of a power of attorney.
Power of attorney is a legal instrument that authorizes a trusted individual to manage financial, property, or health matters on behalf of someone else. Dorothy, 68, from Bristol, transitioned from being an occupational psychologist and business owner to a full-time caregiver for Melvin, who suffered from ataxia, a progressive brain disorder affecting movement and communication.
During a hospital stay in March 2025, a doctor deemed Melvin lacked mental capacity for discharge, attributing it to communication difficulties rather than actual incapacity. Dorothy, who was not present during this evaluation, had to demonstrate her ability to care for Melvin to facilitate his release.
Following Melvin’s passing at age 78 in June 2025, Dorothy shared her experience on National Power of Attorney Day to highlight the significance of this legal tool. She emphasized the challenges they faced due to the absence of power of attorney and encouraged others to establish one promptly.
Carers UK and Standard Life collaborated to launch the inaugural UK-wide Power of Attorney Day, revealing that only 8% of adults possess an updated power of attorney. Despite this, less than half of individuals (46%) view it as a priority, a trend that persists with age.
Helen Walker, CEO of Carers UK, stressed the importance of proactive planning, urging carers and their loved ones to discuss and establish power of attorney in advance to honor preferences and alleviate future stress. Claire Hawkins, Director at Standard Life, echoed this sentiment, emphasizing the safeguarding role of power of attorney in managing finances during unforeseen circumstances.
By choosing to set up power of attorney post-discharge, Dorothy aims to raise awareness and empower others to take similar steps for future security.
