Union leaders are celebrating a significant victory for employees, with 9.6 million individuals gaining improved sick pay entitlements following an extensive campaign. Today marks the implementation of new legislation that will grant 1.2 million low-wage workers access to statutory sick pay for the first time. Additionally, 8.4 million more workers will now qualify for sick pay from day one, with thousands also securing new paternity leave rights.

These changes represent the initial set of provisions from the prominent Employment Rights Act. TUC General Secretary, Paul Nowak, expressed, “Today is a pivotal moment for workers. Following persistent efforts by unions and employees, the initial individual rights under the Employment Rights Act are being enforced – and they are set to have a profound impact nationwide.”

The introduction of sick pay for all workers from the first day of illness is a significant advancement. Previously, many low-income workers, particularly women, were excluded from sick pay benefits. Moreover, eligible employees had to endure a four-day waiting period before making a claim.

Under the new regulations, employees will now receive Statutory Sick Pay from the onset of their sickness absence, irrespective of their salary level. This adjustment is projected to provide an additional £400 million annually in sick pay, aiming to ensure individuals can recuperate without financial concerns.

Employment Minister Dame Diana Johnson emphasized, “No individual should face the dilemma of choosing between their health and livelihood. The long-standing predicament of sick workers having to decide between losing a day’s pay or working while unwell is being addressed by today’s significant reforms. These changes will aid employees in their recovery while offering businesses the assurance that their workforce can return healthier and more productive.”
